If the studies submitted are deemed insufficient by the Agency, it shall be mandatory to submit the results of clinical trials conducted with the new combination, the scope of which shall be determined by the Agency.

d) In fixed combination applications made for medicinal products containing active substances that are used in the composition of human medicinal products authorised worldwide but not used in combination for therapeutic purposes, it shall be mandatory to submit the results of clinical trials related to this combination and, where necessary, the results of preclinical tests. This evaluation shall be carried out in the order of the application date. However, the preliminary evaluation procedures of applications deemed appropriate by the Agency's Priority Evaluation Board to be evaluated with priority or high priority in licensing procedures shall be carried out with priority. (3) The necessary evaluation shall be carried out within thirty days of the application file reaching the Agency, and the outcome shall be notified to the applicant. During the assessment of the objection, if deemed necessary, the applicant shall be granted the right to provide oral explanations and defence. (3) The decision resulting from the assessment of the objection is final, and no objection may be made to the Agency regarding the said decision. However, applications for medicinal products for human use which are scientifically and technologically demonstrated to provide superiority over a licensed medicinal product for human use, or which have a justification deemed appropriate by the Agency, shall be assessed separately. In the assessment concerning the acceptance of the active substance(s) as being the same within the scope of this paragraph, subparagraph (i) of the first paragraph of Article 4 shall be taken as the basis.
