TİTCK Legislation Interpretation: When Does Insurance Exemption Apply in Clinical Trial Applications, and How Does the Process Work?

Under the legislation of TİTCK (Turkish Medicines and Medical Devices Agency), insurance exemption may apply in certain cases during the conduct of clinical trials. Insurance exemption may be requested by the principal investigator of the trial in cases where the risks to which participants may be exposed during the trial are not covered by insurance. These cases can generally be classified as follows:

  1. Nature of the Trial: If the clinical trial is an observational study that only evaluates the effectiveness of existing treatment methods and does not involve any intervention on the participants, an insurance exemption may be requested.

  2. Status of the Participants: An insurance exemption may be requested if the individuals participating in the trial are in a condition to assume the risks of the trial due to their current health status or treatment processes.

  3. Legal Regulations: In accordance with the legal frameworks and regulations determined by TİTCK, an insurance exemption may be requested under certain conditions. These conditions are determined by the current provisions of the relevant legislation.

Process

The insurance exemption request process includes the following steps:

  1. Application Preparation: Trial sponsors must prepare the documents containing the insurance exemption request. These documents should include the purpose of the trial, its design, and the potential risks to the participants.

  2. TİTCK Application: The prepared documents must be uploaded to TİTCK's electronic application system (EBS/KAP) to make an official application. During the application, the justifications for the insurance exemption request must be clearly stated.

  3. Evaluation Process: TİTCK carries out the necessary evaluations after receiving the application. During this process, it is checked whether the application is complete and compliant with the legislation.

  4. Notification of Result: TİTCK notifies the applicant of the evaluation result. If the insurance exemption request is approved, the approval process is completed together with the relevant documents.

  5. Implementation: After the insurance exemption is approved, the clinical trial process can be initiated. Throughout the trial, necessary measures must be taken to ensure the safety of the participants and to manage potential risks.
